Abstract: The word "enterprise",displays different meanings in the different fields.Therefore,the nature of "enterprise" should separately be determined by legislator’s wish and goal.The civil law and the commerciallaw protect people’s private interest and regard the enterprise as the law object.In order to show the protection to the social public interest,the economic law regards the enterprise as the law subject,and makes the enterprise to become the personalized social economy cell.
